As long as the actions aren't discernible or creating a public disturbance, no criminal offense occurs. However, the house and pool rules apply everywhere in the pool. The lifeguard can still kick amorous lovebirds out as soon as they become aware of the activities.

The beach or lake scenario varies slightly. Although house rules are less likely to exist, there's still the risk of being spotted, warns Allesch. In case of discovery, hanky-panky participants could still face criminal or public order charges. He advises, "So, it's not something we can wholeheartedly recommend."

Allesch suggests all parties should consider the potential onlookers' perspective before engaging. If you start questioning the appropriateness, you've probably crossed a line. While such encounters may offer excitement, "legally speaking, they're best left to more private settings," Allesch cautions.
