Alternative methods for settling disagreements concerning organ donations
In a bid to address the stagnating number of organ donations in the country, Germany is set to introduce presumed consent for organ donation. This shift, which means all people would be considered potential organ donors unless they actively opt out, has been a long-awaited move for many.
The decision to resubmit the bill was made by the Minister Council, following the lead of the German state of Baden-Württemberg and several other states. Baden-Württemberg, known for its proactive stance, has seen the wish of the deceased known in only 35% of possible organ donation cases, and a written declaration of intent for organ donation available in just 15% of potential donors.
The initiative, which could not be pursued further due to the collapse of the traffic light federal government, is now being taken up again. The ministry responsible for submitting the proposal on the introduction of presumed consent for organ donors in the Bundestag is the Federal Ministry of Labour and Social Affairs (Bundesministerium für Arbeit und Soziales).
The move is supported by Health Minister Manne Lucha, who believes that a paradigm shift towards a culture of organ donation can be achieved in Germany. Lucha emphasized that it's high time to move towards a culture of organ donation and implement the will of the majority who support organ donation, as surveys indicate that more than 80 percent of people support organ donation.
Despite intensive care units' sensitization campaign for organ donation, the situation remains stagnant in Germany. Relatives still reject organ donation in some cases, leading to the loss of urgently needed organs. This issue is particularly concerning, as German patients disproportionately benefit from donor organs from other countries that have a culture of organ donation.
The Minister of Social Affairs, Health, and Integration in Baden-Württemberg, along with Lucha, is actively advocating for a change in the organ donation system. They hope that the introduction of presumed consent will help to address the current stagnation and ensure that more lives can be saved through organ donation.
